Re-Use Release for User-Generated Content (UGC)

Updated June 2020

We love when Taste of the Wild fans share photos, videos and stories about their pets — including the content you posted! These terms explain how we intend to use the content you’ve shared and reflect your and our agreement regarding their use on our social media channels, email newsletters, website and in other marketing materials.

In this agreement, “content” includes but is not limited to photos, graphics, images, videos, reviews, testimonials, Facebook or Instagram stories or information about you or your pet that you have willingly shared. It does not include private or sensitive information.

By replying to us with your agreement, you grant to Taste of the Wild and its affiliates a non-exclusive, perpetual, irrevocable, transferable, sublicensable, worldwide, royalty-free license to modify, copy, reproduce, publish, add to, edit, exploit and otherwise use the image, video or statement in any form (including, without limitation, video, internet posting, reproduction, email, website, publication and distribution), for any purpose, including, without limitation, for advertising, promotional, trade, commercial or any other purposes and without further review, notice, approval, consideration or compensation.

You represent and warrant that 1) you own any and all copyright(s) to the images, videos and statements, and 2) that you have all the necessary rights or permissions to allow Taste of the Wild to use the images and statements. You also agree to indemnify and hold Taste of the Wild harmless from and against any third-party claims, losses, damages, liabilities, costs and expenses (including reasonable attorney’s fees) related to any breach of these representations and warranties.

You also hereby release and discharge Taste of the Wild, its employees, agents, successors, licensees and assigns from any and all claims you might have in connection with our use of the images, videos and statements, including, without limitation, any claims for copyright, trademark, defamation, violation of any moral or artist right, and/or any right of privacy or publicity.

You grant Taste of the Wild the right to use your name, your pet’s name(s), images, likeness, voice, photograph and/or video in connection with Taste of the Wild’s use of your images, videos or statements, without restriction as to frequency, duration or territory, and without further review, notice, approval, consideration or compensation, except as prohibited by law.

This Image & Statement Use Agreement shall be governed by the laws of the State of Missouri (excluding all conflicts of laws principals that would require the application of the laws of a different state).

If you agree to these terms, please reply to our comment, message or email to confirm your agreement, or (when applicable) select the checkbox indicating you have read and agreed to the terms.
